In the below Terms of Service, Company refers to DigitalWorldHost.com.

DigitalWorldHost.com is providing its services to the individual or group on an as is basis and reserves the right to refuse or terminate accounts or services as seen appropriate by the Management and Staff of the Company. Under no circumstances will exceptions be made for any User to redeem any such service that has been violated against by any

user on these servers.

By registering with the Company, you agree to these terms as set out hereunder by the Company and also agree to comply fully with the Terms as set out hereunder.

No Unlawful Or Prohibited Use:

As a condition of your use of the Company’s services, you will not use the Company’s services for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not attempt to gain unauthorized access to any the Company’s servers, other accounts, computer systems or networks connected to any of the Company’s services, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Company services.

The Company reserves the right at all times to disclose any information deemed necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in the sole discretion of the Company.

The Company is within the capacity to refuse service to unlawful parties. The company servers can be used explicitly for legal purposes only and each attempt for taking indecent advantage of the servers inconsistent with the rules will be immediately rejected. In this light, the Company expressly forbids any breach of Federal, State or Local regulation, including, but is not limited to, the transmission of: copyrighted material, material legally judged to be threatening or obscene and material protected by trade secrets.

The Company’s management will thoroughly scrutinize any of the received orders and decide to their own discretion which of them do not comply with the officially stated requirements for use of the Company's servers. The Company’s servers CANNOT be used for the propagation, distribution, housing, processing, storing, or handling in any way of lewd, obscene, child pornographic material, or any other material which is considered impermissible by the Company including, but not limited to – child pornography, and adult material movies. The company does allow legal adult material which is not in the media of a movie.

Termination Of Services:

You agree that the Company, in its sole discretion and without warning, may terminate your password, account (or any part thereof) or use of the Service, and remove and discard any Content within the Service if you violate these terms.

Payment and Cancellation Policy:

Once you have registered with our services, you agree that Payment will be according to your payment cycle without delay and that delayed payments will incur a 35% delayed payment fee. After 14 days of payment failures, your account will be suspended, whereas a $30.00 rectivation payment will be required.

DigitalWorldHost offers a 14 day money-back guarantee. If, for whatever reason, you are not satisfied with our hosting services; within 14 days we will provide you with a full refund. After the 7 day period, however, we will only provide you with a 50% refund for the first half of your payment period.

You will void the money-back guarantee if you break our TOS in any way or form at anytime.

Your Responsibilities:

You are solely responsible for the content of your web sites. Using the Company’s Service in connection with surveys, contests, pyramid schemes, chain letters, junk e-mail, spamming or any duplicative or unsolicited messages (commercial or otherwise) is prohibited.

In consideration of your use of the Service, you agree to:

1. Provide true, accurate, current and complete information about yourself as may be requested form the Management and/or Staff of the Service.

2. Maintain and promptly inform us to update Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or the Company has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, the Company has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof).

3. You will receive a password and account designation upon completing the registration process of the Service. You are responsible for maintaining the confidentiality of your password and account, and you are fully responsible for all activities that occur under your password or account. You agree to:

- immediately notify the Company about any unauthorized use of your password or account or any other breach of security

- ensure that you exit from your account at the end of each session. The Company cannot and will not be liable for any loss or damage arising from your failure to comply with this.

4. Harm to The Company Servers:

- any attempts for doing harm to a server or customer of the Company’s services are explicitly banned.

5. Acceptable Use of Services / Acceptable Access to Services:

The Company will immediately and resolutely react to any attempt of use of an Internet account or computer by a Company customer unauthorized by the account or computer owner. Such attempts include "Internet scamming" (tricking other people into releasing their passwords and etc.), password robbery, security hole scanning etc. It DOES NOT matter whether the attacked account or computer belongs or not to the Company Services, the fraud will be subject to actions based on the very nature of the attack which could be a warning, an account suspension or cancellation and civil or criminal legal action.

Our Promise:

The Company promises a uptime of 99.9%. However, we do not provide any site uptime monitoring services or scripts; it is the responsibility of the user to install such a script. You must have proof of down time, from a 3rd party uptime script or service, to be considered for compensation. We provide compensation in the forms of additional hard drive space and/or bandwidth. Should your website be offline for more than 24 hours due downtime, we will provide you with a full refund for the month. Howveer, We do not provide compensation for downtime cause by technical mishaps caused by or associated with, but not limited to:

1. Matters and circumstances beyond the control of the Company. Such as but not limited to acts of sabotage, limitations by the governing body, "Act of Nature" (flooding, earthquakes, tornados etc), failure of third party hardware and/or software.

2. Attacks on the Company's system by hackers and other people

3. Scheduled downtime (ie. server upgrades and/or maintenance)

4. Any sort of hardware failure (ie. hard drive failures, cable failures)

Copyright:

Copyrighted material must not be placed on Customers' accounts without the permission of the copyright owners or people that are specifically authorized by the copyright owners. Only copyright owners or people specifically authorized by them may upload copyrighted material to the account.

Upon our receipt of a notice of a claimed copyright infringement containing the above information, after confirmation we will promptly remove the allegedly infringing material from the Services and carry out further procedures if necessary. We will assume no liability to any Customer of the Services for the removal of any such material.

In addition to these terms, as ammended on September 30, 2005, accounts suspended for illegal behaviour, will be legally subjected to a penalty of $50.00

This payment must be made to the Company before an agreement can be made on the future of the offending web site/forum.
